Welcome to My Magic Song.
These Terms of Service (“Terms”) govern your access to and use of the My Magic Song website, online store, products, and services (collectively, the “Services”).
Throughout these Terms, “My Magic Song,” “we,” “us,” and “our” refer to My Magic Song.
Our online store is powered by Shopify, which provides the e-commerce platform that allows us to offer our products and Services to you.
By accessing our website, placing an order, selecting a Video Privacy option, submitting personalization materials, or otherwise using our Services, you agree to these Terms.
Please read them carefully before making a purchase.
1. OUR SERVICE
My Magic Song creates personalized digital entertainment products for children.
Depending on the product purchased, your order may include:
• A personalized animated character
• An original personalized song
• Personalized lyrics
• A custom story or adventure
• An animated video featuring the personalized character
• The child’s name, interests, hobbies, favorite activities, or other personalization details
• Digital delivery of the completed product
Each My Magic Song product is individually created based on information and materials submitted by the customer.
Unless specifically stated otherwise, My Magic Song products are digital products and no physical item will be shipped.
2. ADULT PURCHASES AND PARENT/GUARDIAN AUTHORITY
Our purchasing Services are intended for adults.
By placing an order, you represent that you are legally capable of entering into a binding agreement in your jurisdiction.
Children should not independently place orders, submit payment information, create customer accounts, or submit personal information through our Services.
If you provide photographs, videos, names, information, or other materials relating to a child, you represent and warrant that you are the child’s parent or legal guardian, or that you have appropriate authorization from the child’s parent or legal guardian to provide those materials and authorize their use in accordance with the Video Privacy option selected at purchase.
3. PERSONALIZATION MATERIALS
To create your personalized product, we may request information such as:
• Child’s first name
• Age
• Photographs
• Interests
• Hobbies
• Favorite animals
• Favorite activities
• Favorite places
• Preferred themes
• Pronunciation guidance
• Story ideas
• Other information reasonably necessary to personalize the product
You are responsible for providing complete and accurate information.
Please review all names, spelling, pronunciation instructions, and personalization details carefully before submitting them.
4. YOUR RIGHTS TO SUBMITTED MATERIALS
By uploading or providing photographs, images, text, names, instructions, or other materials to My Magic Song, you represent and warrant that you have the necessary rights, permissions, and authority to provide those materials to us and authorize their use as described in these Terms.
You agree not to submit content that:
• Infringes another person’s intellectual property rights
• Violates another person’s privacy or publicity rights
• Is unlawful
• Is fraudulent
• Is abusive or threatening
• Contains inappropriate sexual content
• Exploits or endangers a child
• Contains malicious software or harmful code
• Is otherwise inappropriate for our Services
We reserve the right to refuse materials or personalization requests that we reasonably believe violate these Terms or applicable law.
5. PERMISSION TO CREATE YOUR PERSONALIZED PRODUCT
When you submit photographs, information, or other personalization materials, you grant My Magic Song a limited license to use those materials as reasonably necessary to create, process, revise, support, and deliver the personalized product you ordered.
This production license applies regardless of which Video Privacy option you select.
The original photographs and other source materials you submit remain subject to the rights of their respective owners.
Purchasing the Share & Save option does not, by itself, authorize My Magic Song to separately publish your original submitted photographs as standalone promotional content.
The rights relating to publication of the completed personalized video are explained in Section 13 below.
6. CREATIVE INTERPRETATION
My Magic Song provides a creative and artistic service.
Our characters, songs, stories, lyrics, animation, environments, voices, and other creative elements involve artistic interpretation.
A personalized animated character is inspired by the photographs and information provided by the customer but is not intended to be an exact photographic reproduction of the child.
Songs, lyrics, stories, voices, animation styles, scenes, movements, backgrounds, and other creative elements may vary from customer expectations or from examples previously displayed by My Magic Song.
Examples shown on our website, YouTube channel, social media, advertisements, or other promotional materials demonstrate the general concept and style of our Services. They do not guarantee that every personalized product will look or sound identical.
Every My Magic Song video is unique.
7. ORDERS AND PAYMENT
Payment is required before production begins unless otherwise expressly agreed.
Prices displayed on our website are the prices applicable at the time the order is placed, subject to applicable taxes, fees, discounts, or promotions displayed during checkout.
Unless explicitly stated otherwise during checkout, purchases are one-time payments and do not create recurring subscriptions.
The price of your personalized video may vary depending on the Video Privacy option selected.
We reserve the right to:
• Refuse an order
• Cancel an order that we cannot reasonably fulfill
• Request additional personalization information
• Correct pricing or product-description errors
• Limit quantities
• Decline inappropriate personalization requests
If My Magic Song cancels an order before providing the personalized product for reasons unrelated to customer misconduct, an appropriate refund will be provided where applicable.
8. PRODUCTION TIME
Our standard production target is 3 business days after we receive all information and materials reasonably necessary to begin production.
The production period may not begin until we have received the required:
• Photographs
• Personalization information
• Customer instructions
• Payment
• Any other materials necessary to complete the order
Business days do not include weekends or applicable holidays.
The 3-business-day timeframe is our standard production target and may occasionally be affected by circumstances outside our reasonable control, unusually complex requests, technical problems, incomplete customer information, or other production-related issues.
If additional information is required from the customer, production may be paused until the requested information is received.
9. DIGITAL DELIVERY
Completed personalized videos are delivered digitally.
Delivery may be made through:
• Email
• Download link
• Customer account
• WhatsApp
• Cloud delivery service
• Another digital delivery method communicated to the customer
Customers are responsible for providing accurate contact information.
If you experience difficulty accessing your completed product, please contact us and we will make reasonable efforts to provide access to the file.
10. REVISIONS
Each personalized order includes one round of reasonable revisions at no additional charge, unless otherwise stated on the product page.
Reasonable revisions may include minor corrections or adjustments such as:
• Correcting information that we included incorrectly
• Minor character adjustments
• Minor visual changes
• Small lyric or text adjustments
• Minor scene modifications
• Other reasonable changes that do not substantially alter the original concept
The included revision does not cover a complete recreation or substantial change in creative direction.
Requests such as creating an entirely new song, changing the complete story, changing the primary theme or adventure, redesigning the entire character, or recreating a substantial portion of the animation may require an additional fee or may be declined.
We will inform you before performing work that requires an additional charge.
Errors clearly made by My Magic Song based on information correctly provided by the customer will be reasonably corrected without additional charge and will not necessarily count as the customer’s included revision.
11. REFUNDS AND CANCELLATIONS
Because our products are personalized digital products created specifically for each customer, all sales are generally final once production has begun.
We do not generally accept returns, exchanges, or refunds for personalized products once production has started.
If you wish to cancel an order, please contact us immediately.
If production has not yet begun, we may, at our discretion, be able to cancel the order.
Once production begins, cancellation and refund requests will generally not be accepted.
Nothing in these Terms limits any consumer rights that cannot legally be excluded under applicable law.
12. PRIVACY AND CHILDREN’S INFORMATION
Protecting customer and child information is important to My Magic Song.
Information and photographs submitted for personalization are handled according to our Privacy Policy.
Because our products are designed for children but purchased by adults, parents and legal guardians may provide limited information about a child for personalization purposes.
We use that information as reasonably necessary to create, process, revise, support, and deliver the personalized product.
The treatment of a completed personalized video for promotional purposes depends on the Video Privacy option selected by the customer when placing the order.

13. VIDEO PRIVACY OPTIONS AND PUBLICATION LICENSE
My Magic Song currently offers two Video Privacy options for personalized videos.
The customer selects the desired option before purchasing the product.
A. SHARE & SAVE ✨
The Share & Save option is currently offered at $200 USD unless another price is displayed at the time of purchase.
By selecting and purchasing Share & Save, you represent that you are the child’s parent or legal guardian, or otherwise have sufficient legal authority, and you grant My Magic Song permission and a non-exclusive license to use, reproduce, display, publish, distribute, edit, excerpt, adapt, and promote the completed personalized video for My Magic Song’s legitimate business, portfolio, advertising, and promotional purposes, subject to applicable law.
This may include use on:
• The My Magic Song website
• YouTube
• Facebook
• Instagram
• TikTok
• Other social media platforms
• Digital advertisements
• Promotional videos
• Portfolio materials
• Marketing campaigns
• Other official My Magic Song promotional or commercial channels
This permission may include monetized content and paid advertising featuring the completed personalized video.
The Share & Save license applies to the completed personalized video and content incorporated into that finished production.
It does not, by itself, give My Magic Song permission to separately publish the customer’s original submitted photographs as standalone promotional images.
Selecting Share & Save does not prevent you from downloading, saving, enjoying, or sharing your completed video for personal and family purposes.
B. PRIVATE VIDEO 🔒
The Private Video option is currently offered at $250 USD unless another price is displayed at the time of purchase.
If you select and purchase Private Video, My Magic Song will not use the completed personalized video for public advertising, portfolio, social media, website, or other promotional publication without obtaining additional permission from the appropriate parent or legal guardian.
My Magic Song may still access and process the submitted materials and completed video internally as reasonably necessary to create, revise, deliver, provide customer support for, maintain business records relating to, and administer the order.
C. YOUR SELECTION
The Video Privacy option shown on the order at the time of purchase determines which publication terms apply to that order.
Please review your selection carefully before completing checkout.
Prices and available Video Privacy options may change for future purchases. The terms and price presented for your particular order at the time of purchase will govern that order.
14. CUSTOMER USE OF COMPLETED VIDEOS
Regardless of whether you purchase Share & Save or Private Video, purchasing a personalized My Magic Song video gives you a personal, non-exclusive, non-transferable license to use and enjoy the completed product for personal and family purposes.
You may:
• Watch the video
• Download and save it
• Share it with friends and family
• Display it at personal celebrations
• Post it on your personal social media accounts
You may not, without our written permission:
• Resell the video
• Sell copies of the video
• Commercially license the video
• Claim that you created the underlying My Magic Song production
• Use our branding or proprietary production elements to operate a competing service
• Remove or alter ownership notices for the purpose of misrepresenting authorship
The customer's personal-use rights are not reduced by selecting Share & Save.
15. INTELLECTUAL PROPERTY
The customer retains whatever rights the customer has in original photographs, information, and other materials submitted to My Magic Song.
My Magic Song retains all rights in its pre-existing and proprietary intellectual property, including, where applicable:
• Brand names
• Logos
• Website designs
• Original templates
• Production methods
• Graphic elements
• Animation systems
• Characters owned by My Magic Song
• Proprietary creative assets
• Business materials
• Other intellectual property owned or licensed by My Magic Song
Purchasing a personalized video does not transfer ownership of My Magic Song’s underlying intellectual property, production systems, templates, branding, or proprietary creative materials.
The licenses granted under these Terms allow each party to use the completed product only as described in these Terms.
For Share & Save purchases, My Magic Song additionally receives the publication and promotional license described in Section 13.
16. ARTIFICIAL INTELLIGENCE AND DIGITAL PRODUCTION TOOLS
My Magic Song may use artificial intelligence, digital production technologies, and third-party creative tools as part of our production process.
These technologies may assist with elements such as:
• Character creation
• Animation
• Music
• Voice production
• Image processing
• Video editing
• Story development
• Other creative or technical production tasks
By purchasing our Services, you understand that personalized products may be created using a combination of human creative direction, artificial intelligence, and digital production technologies.
Our use of customer information and personalization materials remains subject to our Privacy Policy, these Terms, and applicable law.
17. THIRD-PARTY SERVICES
Our Services may depend on third-party providers, including Shopify and other providers involved in areas such as:
• Payment processing
• Website hosting
• Communications
• File delivery
• Cloud storage
• Analytics
• Production technology
Your use of certain third-party services may also be subject to their respective terms and privacy policies.
We are not responsible for third-party websites or services that we do not control, except to the extent required by applicable law.
18. PROHIBITED USES
You may not use our website or Services:
• For unlawful purposes
• To violate applicable laws or regulations
• To infringe intellectual property rights
• To harass, abuse, threaten, or harm another person
• To submit unlawful or exploitative content involving minors
• To transmit malware or harmful code
• To interfere with the security of our Services
• To attempt unauthorized access to our systems
• To engage in fraud or misrepresentation
• To misuse personalized content for unlawful purposes
We reserve the right to suspend or refuse Services when we reasonably believe these Terms have been violated.
19. ACCURACY OF WEBSITE INFORMATION
We make reasonable efforts to ensure that information displayed on our website is accurate.
However, occasional errors may occur regarding pricing, descriptions, availability, production times, promotions, or other information.
We reserve the right to correct errors and update information where reasonably necessary.
20. DISCLAIMER
To the extent permitted by applicable law, our Services are provided on an “as available” basis.
Because My Magic Song provides creative personalized products, individual preferences regarding music, animation, character appearance, storytelling, or other artistic elements may vary.
A subjective preference for a different artistic interpretation does not necessarily mean that the product is defective.
Nothing in these Terms excludes warranties, guarantees, or consumer protections that cannot legally be excluded.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, My Magic Song will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of our website or personalized digital products.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
22. INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for claims arising from materials you submit when those materials violate these Terms, applicable law, or the rights of another person.
This includes situations where you submit photographs, videos, names, likenesses, or other content that you did not have permission or legal authority to provide or authorize for the selected Video Privacy option.
23. CHANGES TO THE SERVICES OR THESE TERMS
We may modify our Services, products, pricing, features, policies, Video Privacy options, or these Terms from time to time.
The most current version of these Terms will be posted on our website.
Changes will apply prospectively as required by applicable law and will not retroactively remove rights that cannot legally be waived.
24. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.
25. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Refund & Revision Policy, Shipping/Digital Delivery Policy, and any other policies or terms presented during checkout, constitute the agreement governing your use and purchase of our Services, subject to applicable law.
The Video Privacy option selected and recorded as part of your order is incorporated into these Terms for that purchase.
