My Magic Song offers different Video Privacy options for personalized videos.
The Video Privacy option selected by the customer at the time of purchase determines whether My Magic Song receives permission to publicly use the completed personalized video.
Please review the selected Video Privacy option carefully before completing your purchase.
SHARE & SAVE ✨
If you select and purchase the Share & Save option, you authorize My Magic Song to use the completed personalized video in accordance with our Terms of Service.
This may include publishing, displaying, reproducing, distributing, editing, excerpting, adapting, sharing, and promoting the completed personalized video through official My Magic Song channels and promotional activities, subject to applicable law.
The completed personalized video may appear on:
• My Magic Song’s website
• YouTube
• Facebook
• Instagram
• TikTok
• Other social media platforms
• Digital advertising
• Paid advertising
• Promotional videos
• Portfolio materials
• Marketing campaigns
• Other official My Magic Song promotional or commercial channels
Share & Save content may be used in monetized content or paid promotional campaigns.
Selecting Share & Save does not prevent the customer from downloading, saving, watching, or sharing the completed video for personal and family purposes.
The Share & Save permission applies to the completed personalized video.
Purchasing Share & Save does not, by itself, authorize My Magic Song to take the original photographs submitted by the customer and separately publish those original photographs as standalone advertisements, social media posts, or promotional images.
The photographs may, however, be processed as necessary to create the personalized character and completed video, and elements derived from the submitted materials may appear as part of the completed personalized video.
PRIVATE VIDEO 🔒
If you select and purchase the Private Video option, My Magic Song will not intentionally publish the completed personalized video on our website, YouTube channel, social media accounts, paid advertising, portfolio, or other public promotional or marketing channels without obtaining additional appropriate permission.
We may still access, process, store, and use the submitted materials and completed video internally as reasonably necessary to:
• Create the personalized product
• Complete the order
• Make revisions
• Deliver the product
• Provide customer support
• Troubleshoot technical issues
• Prevent fraud or misuse
• Maintain appropriate business records
• Comply with applicable legal obligations
YOUR VIDEO PRIVACY SELECTION
The Video Privacy option recorded with your order determines how the completed personalized video may be used by My Magic Song.
The available options and their prices may change over time.
Changing prices for future purchases does not change the Video Privacy option associated with an order that has already been completed.
5. ORIGINAL PHOTOGRAPHS AND SOURCE MATERIALS
The photographs and other personalization materials submitted by customers are used as reasonably necessary to create and support personalized products.
The customer retains whatever rights the customer has in the original photographs and materials submitted to My Magic Song.
My Magic Song does not claim ownership of a customer’s original photographs merely because they were submitted for personalization.
We may process submitted photographs through digital production tools and service providers as reasonably necessary to create the personalized product.
Unless separately authorized, My Magic Song will not use a customer’s original submitted photographs as standalone public promotional materials.
This distinction does not prevent My Magic Song from using a completed personalized video under the Share & Save option when the video contains a character or other creative elements developed from the submitted photographs.
6. YOUR CHILD’S PRIVACY MATTERS
We understand that photographs and information about children require special care.
We use information submitted about a child for the purposes described in this Privacy Policy and take reasonable measures designed to protect that information.
Parents and legal guardians may contact us regarding access to, correction of, or deletion of personal information they have provided about their child, subject to applicable law, the Video Privacy option selected for the order, and legitimate legal or business obligations.
