My Magic Song provides personalized digital products created individually for each customer.
Our products may include:

Unless expressly stated otherwise, our products are delivered digitally and no physical product is shipped.
Our website, checkout, and purchasing Services are intended for adults.
Personalized products may feature children based on photographs and information voluntarily submitted by a parent, legal guardian, or other adult who has appropriate authorization to provide those materials.
ADULT AND PARENT/GUARDIAN RESPONSIBILITY
Customers purchasing personalized products involving a child are responsible for ensuring that they have the necessary authority to submit the child’s photographs, name, likeness, and other personalization information.
By submitting materials relating to a child, the customer represents that they are:
• The child’s parent or legal guardian; or
• Otherwise appropriately authorized by the child’s parent or legal guardian to provide the materials and grant the permissions applicable to the selected product option.
Children should not independently place orders, provide payment information, or submit personalization materials through our Services.
PERSONALIZED CONTENT
Customers are responsible for ensuring that they have the necessary rights and authorization to submit photographs, names, information, instructions, and other materials used to create a personalized product.
My Magic Song uses submitted materials as reasonably necessary to create, process, revise, support, and deliver the personalized product.
Personalized characters, songs, stories, voices, animation, scenes, and other creative elements may involve artistic interpretation.
A personalized character is not intended to be an exact photographic reproduction of the child.
VIDEO PRIVACY OPTIONS
My Magic Song may offer different Video Privacy options for personalized videos.
The Video Privacy option selected and recorded as part of the customer’s order determines the public promotional rights applicable to the completed personalized video.
Current options may include:
SHARE & SAVE ✨
When a customer selects and purchases Share & Save, the customer grants My Magic Song the permission and license described in our Terms of Service to use the completed personalized video for authorized business, portfolio, promotional, advertising, and commercial purposes.
Subject to our Terms of Service, Privacy Policy, and applicable law, this may include publication or use through:
• The My Magic Song website
• YouTube
• Facebook
• Instagram
• TikTok
• Other social media platforms
• Digital advertising
• Paid advertising
• Portfolio materials
• Promotional videos
• Marketing campaigns
• Other official My Magic Song promotional or commercial channels
Such use may include monetized content.
The Share & Save permission applies to the completed personalized video as described in our Terms of Service.
It does not, by itself, authorize My Magic Song to separately publish the customer’s original submitted photographs as standalone promotional photographs.
PRIVATE VIDEO 🔒
When a customer selects and purchases Private Video, My Magic Song will not intentionally publish or use the completed personalized video for public advertising, portfolio, social media, website, or other promotional purposes without obtaining additional appropriate permission.
My Magic Song may still process and retain materials as reasonably necessary to create, revise, deliver, support, administer, and maintain appropriate records relating to the order, subject to our Privacy Policy and applicable law.
INTELLECTUAL PROPERTY
The My Magic Song name, branding, website content, graphics, designs, templates, production methods, original creative materials, and other proprietary elements are owned by or licensed to My Magic Song and may be protected by applicable intellectual property laws.
Customers retain whatever rights they hold in photographs and other original materials they submit to us.
Purchasing a personalized product does not transfer ownership of My Magic Song’s underlying intellectual property, branding, production systems, templates, or proprietary creative assets.
Customers receive the rights to use their completed personalized products as described in our Terms of Service.
When Share & Save is selected, My Magic Song additionally receives the publication and promotional rights described in our Terms of Service.
ORIGINAL PHOTOGRAPHS AND PERSONALIZATION MATERIALS
Submitting photographs to My Magic Song does not, by itself, transfer ownership of those original photographs to My Magic Song.
Submitted photographs and personalization information may be processed as reasonably necessary to create the personalized product.
Unless separately authorized, the Share & Save option does not give My Magic Song permission to take original customer-submitted photographs and separately publish them as standalone promotional images.
The treatment of photographs, personalization information, and other personal information is further described in our Privacy Policy.
ARTIFICIAL INTELLIGENCE AND DIGITAL PRODUCTION
My Magic Song may use artificial intelligence, digital production technologies, and third-party creative tools as part of the production process.
These technologies may assist with elements such as:
• Character creation
• Animation
• Music
• Voice production
• Image processing
• Video editing
• Story development
• Other creative or technical production tasks
Personalized products may therefore be created through a combination of human creative direction and digital production technologies.
Our processing of customer and child information remains subject to our Privacy Policy and applicable law.
PRIVACY
Personal information, photographs, and personalization materials are handled in accordance with our Privacy Policy.
The public promotional use of a completed personalized video depends on the Video Privacy option selected by the customer.
Share & Save permits the use of the completed personalized video as described in our Terms of Service and Privacy Policy.
Private Video does not authorize public promotional use of the completed personalized video without additional appropriate permission.

DIGITAL PRODUCTS AND DELIVERY
Unless expressly stated otherwise, My Magic Song products are digital products.
No physical product is shipped.
Our standard production target is generally three business days after all required payment, photographs, personalization information, and other materials reasonably necessary to begin production have been received.
Production and delivery are subject to the terms described in our Delivery & Shipping Policy.
REFUNDS AND REVISIONS
Because My Magic Song products are personalized digital products created specifically for individual customers, orders are subject to our Refund & Revision Policy.
Personalized orders generally become non-refundable once production has begun, except where otherwise required by applicable law.
Each personalized video currently includes one round of reasonable revisions unless otherwise stated on the applicable product page.
